ACCEPTANCE OF TERMS
The Terms and Conditions (“TAC” , “Terms of Use”) of this document is a legal Agreement between you being, as an Agent (“Member”, “User” “You”) and Moonline Travel and Trade Ltd (“Moonline” , “Babylon Holiday”, “we”, “our”, “us”), the owner of www.babylonholiday.com (“Babylon Holiday”, “website”, “portal”). Moonline, through its website as a travel agency provides various travel and tourism related services (Services).
By using our website or signing up for an account, you accept these terms and conditions in full. If you disagree with the whole or any part of these terms and conditions, you must not use our website.
Our website uses cookies. By using our website and agreeing to these terms and conditions, you consent to our use of cookies in accordance with the terms of our privacy policy.
The services that Moonline provide to User are subject to the following Terms and Conditions (TAC) and the whole content of this agreement.
- User is responsible for all User’s Account (under any screen name or Password) and for ensuring that all use of User’s Account complies fully with the provision of this Agreement.
- User shall be responsible for protecting the confidentiality of User’s password(s). Thus, you’re responsible for keeping your account name and password confidential.
- You’re also responsible for any account that you have access to and any activity occurring in such account. You’ll immediately notify us of any unauthorized access or use of your accounts. We’re not responsible for any losses due to stolen or hacked passwords that are caused by or result from your negligence.
- We don’t have access to your current password, and for security reasons, we may only provide you with instructions on how to reset your password.
- Moonline have the right to update any of your contact information in your account for billing and other purposes so as be able to deliver its services to you. In addition, you represent and warrant that all information you provide to us when you establish an account, and when you access and use our services, is and will remain complete and accurate.
- Moonline shall have the right at any time to change or discontinue any aspect or feature of its portal ( www.babylonholiday.com ).
- You are recommended to review our Terms & Conditions frequently and/or whenever you wish to use our website & services. The most current and updated version of the TAC can be reviewed by clicking on the “Terms and Conditions” hypertext link located at the bottom of our portal/website.
Change in Terms and Conditions
Babylon Holiday shall have the right to change and modify and update these terms and conditions at any time without any notice. Changes will be effective as soon as they are published on the Babylon Holiday’s website.
DESCRIPTION OF SERVICES
www.babylonholiday.com is an online Travel and Tourism related portal dedicated to providing quality services to its partners/clients such as hotel accommodation, tour/activities and holiday packages.
The services, including any updates, enhancements, new features are subject to the TAC.
A) HOTEL AND OTHER ACCOMMODATION TYPE BOOKINGS
Online Booking/Reservation
All bookings/reservations must be made online. When a Member/Agent of the Babylon Holiday has completed the booking online, it is their responsibility to check and make sure all the reservation details (such as hotel address, hotel info, city and country details) on the pre-paid accommodation voucher are correct. Once the reservations/requests are confirmed, Babylon Holiday cancellation, amendment, no-show policy is stated in the cancellation policy before booking or at the booking confirmation. Payment and refund/discount policies will be applicable to the Members/Agents that are using Babylon Holiday system.
Names of Persons Travelling
The names of the people who are traveling must be entered correctly by the agents. The first name should be followed by the Family name and any abbreviations or signs entered as the guest’s name may cause rejection of booking by the hotel.
Room Types
Babylon Holiday members are responsible for making sure the room types booked are certainly suitable for the people who are going to travel. If the number of people who show up at the hotel are more than the capacity of the rooms booked, the hotels may not accept the booking and no refunds will be made in this case.
Special Requests
It is always guaranteed that the room provided by the hotel will accommodate the number of Customer(s) booked. Specific room types, smoking preferences and bedding types for double/twin rooms cannot be guaranteed and are subject to availability at the time of check in.
Late Check-in
If a customer is expected to arrive later than regular check-in time of the hotel, then either the customer or Agent should inform the hotel about the late arrival beforehand. Failing to inform the hotel of a late arrival can result in the space/room (s) being released.
Early Checkout
Early checkout related refund demands should be accompanied with the hotel issued early checkout permission. Refunds may be claimed if and when our partner hotel does not invoice Babylon Holiday. However, the early checkout permission itself does not guarantee any refund.
Hotel Categories/ Local Classification and Star (*) Ratings
Star rating is a general overview of hotel regarding the approximate level of facilities, services and amenities available. However, this rating might be different from a country to another; For example, a 5* Kuala-lumpur hotel is not the same as a 5* Paris hotel.Babylon Holiday does not take the responsibility of the hotel categories and star (*) ratings since these have been provided to us and we accept and offer them as they are.
Payment and Rates
Currency exchange rates are based on any related market fluctuations. Babylon Holiday shall have the right to update room rates on the website considering the market fluctuations.
Rates might change to reflect exchange rate fluctuations up until the booking is fully paid, for bookings that are made in currencies other than EUR, USD. Once the booking is fully paid, there will be no more changes.
Local Market Rates
Not all of the hotel rates displayed on the Babylon Holiday website are applicable for the local market. In addition, some other markets may be affected and in such cases the hotel is within their rights to change the rates without prior notice.
You agree that the Passenger nationality declaration is mandatory and must be determined by selecting “Client Nationality” at the time of booking. This information must be in accordance with the Passenger passport. False declaration of Passenger nationality may cause consequences for which we cannot be held liable. If you (the Agent) does not change the Client’s Nationality, then the Agent’s nationality will be taken as the Passenger nationality by default. In case, any financial damage occurs due to false nationality declaration, it will be covered by the Agent towards its customers or to us (Babylon Holiday) in full.
Resort Fees
Some Hotels in special countries charge a “resort fee” which is typically between $10 to $20 per night and per room and directly must be paid to the hotel. This is regulated and implemented by a related law by the government and Babylon Holiday has no control over these charges.
Additional & Incidental Charges
The fees that are displayed on Babylon Holiday website may not include any additional charges that hotels apply for some specific services such air conditioning, safe box, mini bar, TV rental, luggage storage, sauna, spa, swimming pool, car parking, etc.
Also, some hotels may hold special events during the festive time such as Christmas, and New Year, and guests must pay a compulsory charge for participating at these events. Babylon Holiday may not always be informed about such events and can not be responsible for the additional charges by the hotels.
Cancellations & Amendments
We prefer that all cancellations and amendments are made on the Babylon Holiday website. Alternatively, you can contact the Babylon Holiday Reservation Team via e-mail or through the Babylon Holiday system before the cancellation deadline for that specific booking/hotel. We do not accept cancellations or amendments over the telephone.
Babylon Holiday will not take any responsibility for any changes and cancellations made directly with the hotel.
All requests for cancellations that are not made in a proper time frame are subject to a cancellation fee determined by Babylon Holiday.
Split Amendment
Babylon Holiday system does not allow to make split changes for multiple room bookings in case of a split amendment. If the cancellation and amendment policy is foreseen to be changeable, please make a new reservation for split room/s and inform Babylon Holiday support Team in order to try to serve as per your request.
Duplicate Bookings
Babylon booking never guarantee a confirmation of duplicate booking. You need to amend one of reservations according to voucher condition. If the hotel rejects to confirm duplicate bookings the agency shall take the responsibility.
Relocation of Your Clients
The hotelier or provider takes the responsibility of finding you a similar standard alternate accommodation in case the hotel booked is overbooked, closed, has maintenance problems and/ or cannot provide the rooms booked. If we receive any notice before hand Babylon Holiday will inform you by an e-mail.
Babylon holiday constantly tries to provide one alternative in the desired area, but the situation may change according to the city and season.
Babylon Holiday accepts no liability for any losses or costs that might occur as a result of re-location as this is completely beyond Our (Babylon Holiday) control.
Complaints
Babylon Holiday must be notified in case there is any issue or complaint that cannot be resolved at the hotel. you can use one of these ways to complain:
1- Log into your Babylon Holiday system and select the booking you want to complain about, then send us a message through the system explaining the issue.
2-Send us an email and include the booking ID.
Babylon Holiday must be notified within 15 days after checkout date. A copy of complaint must be also submitted to and signed by hotel manager.
Babylon Holiday will forward the complaints to relevant party. our team tries its best to reply to the complaints in a short period that may vary between 5 to 20 business days.
USER CONDUCT
Babylon Holiday portal contain copyrighted material, trademarks and any other business proprietary information, including text, software, photos, videos, graphics and the entire content of www.babylonholiday.com which are copyrighted as collective work and property of Moonline.
User may not modify, publish, transmit, participate in the transfer or sale, or in any way to exploit any of the content, in whole or in part.
MEMBER ACCOUNT, PASSWORD AND SECURITY
User must complete the registration process for Login by providing with current, complete and accurate information as prompted by the applicable registration form. User also will choose a password and a user name and protect them. User is entirely responsible for maintaining the confidentiality of User’s password and account. Furthermore, User is entirely responsible for any and all activities that occur under User’s account.
User agrees to notify us immediately of any unauthorized use of User’s account or any other breach of security. Moonline will not be liable for any loss that User may incur as a result someone else using User’s password or account, either with or without User’s knowledge. However, User could be held liable for losses incurred by Moonline or another party due to someone else using User’s account or password to harm our portal. User may not use anyone else’s account at any time, without the permission of the account holder.
LIMITATIONS OF LIABILITIES
As a result of using our website (s)/portal (s) and its application/features, we will not be liable to you in respect of any:
- Losses arising out of any event or events beyond our reasonable control.
- Loss of or damage to profits, income, revenue, or anticipated savings.
- Loss of management time or office time.
- Loss of business, contracts, commercial opportunities or goodwill.
- Loss or corruption of any data, database or software.
- Special, indirect or consequential loss or damage.
- Any losses arising out of any acts or omissions of any hosting services provider, payment services provider or other third-party services provider.
- Business losses or damage of any nature.
WEBSITE AVAILABILITY
From time to time the website or features of the website will be unavailable. Such unavailability may be the result of defects in the website software, scheduled or emergency maintenance procedures, or failures of third-party service providers. We do not commit to ensuring that the website will be available at any particular time. Furthermore, we do not commit to ensure that the website will continue to be published in the future.
INDEMNITY
You hereby indemnify us and undertake to keep us indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by us to a third party in settlement of a claim or dispute) incurred or suffered by us arising out of any breach by you of any provision of these terms and conditions, or arising out of any claim that you have breached any provision of these terms and conditions.
SEVERABILITY
If it turns out that a section of these Terms isn’t enforceable, then that section will be removed or edited/altered as little as required to provide correct legal meaning, and the rest of the Agreement will still be valid.
FORCE MAJEURE- DISCLAIMER OF WARRANTY; LIMITATION OF LIABILITY
Neither Moonline nor the Agent will be responsible/liable for any failure or delay in performance and/or delivery of their services, or any loss, injury, or inability of a passenger to perform the Voyage due to circumstances beyond its reasonable control, including without limitation war, riot, embargoes, strikes/demonstrations, hijackings, acts of civil or military authorities, act of terrorism, fire, floods, accidents, volcanic eruptions or other natural conditions of the earth or weather which make it or impossible for passenger to travel to the final destination.
Entire Agreement
If any provision of these terms and conditions is or becomes invalid, unenforceable or non-binding, you (The Agent) shall remain bound by all other provisions hereof. In such event, invalid provisions shall nonetheless be enforced to the fullest extent permitted by applicable law, and You (The Agent) will at least agree to accept a similar effect as the invalid, unenforceable or non-binding provision, given the contents and purpose of these terms and conditions.

When You complete the booking online, you must check and make sure all the details on the pre-paid accommodation voucher (such as hotel address, hotel info, city and country details) are correct.
Use of the Babylon Holiday.com website is subject to your acceptance of Our terms and conditions. If You do not accept these Terms and Conditions, you must refrain from using the website.
